Self Employed Cleaner Agreement

This Cleaning Services Agreement ("Agreement") is entered into between Best Home Services, hereinafter referred to as the "Company," and the signing party, hereinafter referred to as the "Cleaning Contractor." Collectively, the Company and the Cleaning Contractor shall be referred to as the "Parties."

 

Scope of Services:

1.1 The Cleaning Contractor agrees to provide cleaning services to clients as assigned by the Company.

1.2 The specific cleaning tasks, schedule, and location of services will be communicated by the Company to the Cleaning Contractor on a regular basis.

1.3 You may be offered optional work opportunities by us or our partner companies, including Best Home Services Domestic, Best Home Services Signature, or Best Home Services Commercial. In such cases, the terms and conditions set out in this agreement will apply to all work undertaken.

 

Independent Contractor Relationship:

2.1 The Cleaning Contractor acknowledges and agrees that they are an independent contractor and not an employee, partner, or agent of the Company.

2.2 The Cleaning Contractor has the right to control the manner and means by which they perform the cleaning services, provided the results meet the standards set by the Company.

 

Obligations of the Company:

3.1 The Company shall provide the Cleaning Contractor with information regarding client assignments, cleaning specifications, and any necessary supplies or equipment.

3.2 The Company shall compensate the Cleaning Contractor for services rendered in accordance with the agreed-upon rates and payment terms.

 

Obligations of the Cleaning Contractor:

4.1 The Cleaning Contractor shall perform the assigned cleaning services diligently, professionally, and in compliance with the specifications provided by the Company.

4.2 The Cleaning Contractor shall provide their own cleaning supplies, equipment, and transportation necessary to perform the services.

4.3 The Cleaning Contractor shall maintain appropriate insurance coverage to protect themselves and the Company against liability arising from the provision of services.

Compensation:

5.1 The Cleaning Contractor shall be compensated by the Company at the agreed-upon rate for each cleaning assignment completed satisfactorily.

5.2 Payment terms, including the frequency of payments and any applicable deductions or taxes, shall be outlined in a separate payment agreement between the Parties.

5.2 The subcontractor agrees to carry out all cleaning work to a high standard. If the quality of work falls below the standard expected by Best Home Services and results in a customer complaint, a failed inspection, or any other issue that may require Best Home Services to provide a refund, discount, or rectification, Best Home Services may make a reasonable deduction from the subcontractor’s pay for that job. The deduction will reflect the cost of resolving the issue, including any refund or the cost of sending another cleaner to fix the work.

 

Confidentiality:

6.1 The Cleaning Contractor shall maintain the confidentiality of any client information, trade secrets, or other proprietary information disclosed by the Company during the course of providing services.

 

Term and Termination:

7.1 This Agreement shall commence on the signed date and shall continue until terminated by either Party by providing 3 weeks written notice to the other Party.

7.2 Either Party may terminate this Agreement immediately in the event of a material breach by the other Party.

7.3 Upon termination, the Cleaning Contractor shall promptly return any Company property or confidential information in their possession.

 

Governing Law:

8.1 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or relating to this Agreement shall be resolved through amicable negotiations between the Parties.

 

Entire Agreement:

9.1 This Agreement constitutes the entire understanding between the Parties and supersedes any prior discussions, representations, or agreements, whether written or oral, relating to the subject matter herein.

Non-Solicitation Agreement

​

This Non-Solicitation Agreement ("Agreement") is entered into between Best Home Services ("Company") and the undersigned employee as of the date signed.

 

Non-Solicitation of Clients

During the term of employment and for a period of 6 months following the termination of employment, whether voluntary or involuntary, Employee agrees not to directly or indirectly solicit or attempt to solicit any client or customer of the Company for the purpose of providing cleaning services or any related services outside the scope of the Company's business. Employee further agrees not to disclose or use any confidential information obtained during the course of employment for such purposes.

 

Non-Solicitation of Employees

Employee agrees that during the term of employment and for a period of 6 months following the termination of employment, whether voluntary or involuntary, Employee will not directly or indirectly solicit or attempt to solicit any employee of the Company to leave their employment or engage in any activity that would be detrimental to the Company's business interests.

 

Non-Compete Provision

This Agreement does not constitute a non-compete agreement. Employee is not restricted from seeking employment or engaging in any other business activities that do not violate the terms of this Agreement.

 

Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.

 

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the England. Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in England.

Entire Agreement

This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, or representations, whether written or oral.
